In March 26, 2003 Indiana ruled that, if the jury's decision was unanimous, a judge could not modify a jury's decision to sentenced to death or to award life imprisonment without possibility of parole.
The Governor on the advice of the Parole Board has the power to grant clemency.
The Governor needs a favorable recommendation of the Board to be able to grant clemency. The Governor, however, is not bound by the favorable recommendation.
