Judge David Ellwood announced in the Guernsey County Common Pleas Court that Marvin Johnson would receive the death penalty for the fatal beating and kidnapping of Daniel Bailey, 13. Johnson, 37, was convicted last month for the murder. He also was found guilty of raping and robbing his ex-girlfriend and Daniels mother, Constantina Tina Bailey. For those crimes he received a three 10-year prison sentences to run consecutively before the death sentence.
