Keating vetoes bill banning executions of mentally retarded Legislation that would have exempted mentally retarded defendants from the death penalty was vetoed by Gov. Frank Keating. The measure would have prohibited the state from executing defendants with an IQ of 70 or below who are classified as developmentally disabled.
In his veto message, Keating said the measure is unnecessary because existing state law already protects defendants who lack the mental capacity to understand the consequences of their acts.
The measure's author are Rep. Opio Toure, D-Oklahoma City.
