KENYA: KERUGOYA COURT SENTENCES TWO ORPHANS TO HANG FOR STEALING CELLPHONE

Two orphans have been sentenced to death by a Kerugoya court after they were convicted of robbery with violence.
The two men, Moses Muriithi, 28 and John Kinyua, 30, were sent to the gallows after the court found them guilty of violently robbing a student of a cell phone.
They had been accused that on May 9, 2015 in Karia Village, Kirinyaga County, they robbed Jackson Miano, a Form Two student, of his phone worth Sh1,000 and injured him.
Delivering the sentence, the magistrate, Ms Juliet Kasam, said she found that robbery with violence had been proved by the prosecution beyond any reasonable doubt.
She said the student, Jackson Miano, and his brother were walking home at around 11pm from the nearby market when they were accosted by the accused persons who were armed with pangas and rungus.
Ms Kasam said the two brothers were attacked and wounded.
During the attack, one of the accused persons snatched a mobile phone from the student.
However, they raised the alarm and a resident, a Mr Kanyatha, rushed to their rescue.
It was then that the accused persons fled through the nearby bush after which the student reported the matter to the local police station and recorded a statement.
Later, the duo were arrested by the police and charged with the capital offence.
The officers also recovered the stolen phone which was used as an exhibit when the men appeared in court.
