Maryama, a young woman from Iran, where she risks being stoned to death for pornographic videos, can stay with her family in an Australian detention centre or sign a form which may see her deported to Iran.
Maryama (not her real name) chose not to sign it and, with her family, is now caught in a legal loophole which sees her in detention indefinitely. The Australian Department of Foreign Affairs said in Iran the death penalty applies to the creation of pornographic videos.
However, the Refugee Review Tribunal rejected her claim, saying that while Maryama may face death for her activities, her claims did not satisfy the requirements of the Refugee Convention. In Iran, Maryama was recruited as a hairdresser for women going to illegal "meeting parties". Maryama said the parties were sometimes used to film pornographic videos.
One of the hairdressers was sentenced to life imprisonment for her involvement in the illegal parties, and another sentenced to be stoned to death. In fear of being stoned to death for committing adultery, appearing in the pornographic video and being involved in the illegal parties, Maryama and her family fled in July 2000.
