Nigerians Johnson Oshodi, Tunde Apatira, Oladotun Lukmanu Umaru and a Chinese national from Hong Kong, Chu Tak Fai, appealed to the Malaysia Federal Court for a revision of their death sentences following a decision by the Court of Appeal acquitting mechanic Toh Su Kuan.Toh was sentenced to death for trafficking in dadah which was found strapped to his body.In acquitting Toh on June 11, the Court of Appeal ruled that the accused should know the substance he was carrying was heroin and the chemist report should state the weight of the dadah sample analysed.These issues formed the basis of the motions by the Nigerians and the Chinese respectively.Oshodi, a technician, Apatira, a civil servant, and Umaru, a businessman, were sentenced to death by the Penang High Court on June 30, 1995, for trafficking in heroin at the Butterworth Hospital in Penang on Aug 13, 1990, by stuffing the dadah into pellets and swallowing them.Oshodi, Apatira and Umaru had 118gm, 232gm and 268gm of dadah inside them respectively.The Court of Appeal dismissed their appeals on June 18, 1997, and it was upheld by the Federal Court on June 24, 1999.Chu, 31, a barber, was sentenced to death by the Alor Star High Court on October 11, 1994, for trafficking in 2.12kg of heroin at the Immigration Complex in Bukit Kayu Hitam, Kedah, on April 30, 1993.
