President Vicente Fox proposed writing the death penalty out of Mexican law

President Vicente Fox proposed writing the death penalty out of Mexican law. Fox said his government would send Congress a proposed Constitutional amendment to eliminate a clause that still allowed the death penalty for grave crimes, though the punishment had not been applied in four decades.
Speaking at a military base, Fox said the measure was sent to him by military leaders. The military is the last jurisdiction in Mexico that still applies death penalties.
The measure would underscore Mexico's opposition to US use of the death penalty against a few Mexican citizens.
Constitutional law expert Ignacio Burgoa called Fox's proposal "useless and superfluous."
He said the constitution "only authorizes local (state) congresses to establish the death penalty in local penal codes, but since that has been abolished in all laws, it's absurd for the president to make that proposal."
In November 2003, Fox commuted a military death penalty against an infantry sergeant convicted in 1997 of killing a superior officer. The sentence was changed to 20 years in prison.
The issue also arose in early 2003 when two parties in Mexico State, which borders the capital, sponsored a poll on applying the death penalty there. A majority of those who participated said they approved of the idea.
