Russian Justice Minister Yuri Chaika ruled out the death sentence for Salman Raduyev, who is currently facing terrorism charges in the Dagestani capital of Makhachkala.
"The moratorium on capital punishment and appropriate resolutions of the Constitutional Court are still in force," Chaika told Interfax.
Chaika said in joining the Council of Europe, Russia had committed itself to abolish capital punishment and "we must keep our word".
State Duma Deputy Gadzhi Makhachev, who represents Dagestan, said the death sentence should be passed on Raduyev, who is accused of organizing a terrorist raid against Kizlyar and the village of Pervomaiskoye in January 1996.
