Montenegro adopted a new Penal Code on June 19, 2002 that abolished the death penalty and replaced it with 40 years in jail. Serbia abolished the death penalty for all crimes on February 26, 2002 when a new Penal Code also replaced the death penalty was by a sentence of 40 years in prison. In Kosovo, the death penalty was abolished in 1999 under the UN administration.
The Federal Republic of Yugoslavia had amended the Federal Constitution in 1992 and removed the provision on the death penalty. The Federal Penal Code was amended accordingly in 1993.
