The 5th U.S. Circuit Court of Appeals in New Orleans stopped the execution of Michael Dewayne Johnson, scheduled for February 26, and returned the case to a federal district court for review. Johnson, 25, was convicted of killing Jeff Wetterman, 27, on Sept. 10, 1995.
Johnson's lawyers have been seeking a new trial for him, contending the conviction was invalidly obtained because prosecutors offered perjured testimony and withheld evidence that could have changed the outcome of his trial.
The federal appeals court action allows his attorneys to file a second request with a federal district court judge.
