the Ahmedabad District and Sessions Court in India sentenced a person to death and six others to rigorous imprisonment of 10 years and a fine of Rs 1 lakh each in connection with a narcotics trafficking case.
This is the first ever death penalty given in the state under the provisions of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985. Omarkanth Kak alias Panditiji, was sentenced to death when he and seven associates were caught by the Narcotics Control Bureau in September 2003, with 40 kg of charas near the Kalupur Railway Station. The convicts had procured the narcotic from Kashmir to sell it to various drug dealers in the city. During the course of the trial, it was learnt that Kak had been sentenced to 10 years of rigorous imprisonment in 1988 in another narcotics case. Section 31(A) of the NDPS Act has the provision for awarding death penalty to an offender if he is again found trafficking narcotics in a commercial quantity.
