The Appelate Bench sitting in Nyeri criticised a High Court judge for what it described as "contradictory logic" while passing sentence on five members of the same family charged with murder.
Appelate Judges C J Tanui, Effie Owour and J A Lakha wondered over the rationale used by High Court Judge J V O Juma in releasing four of the accused persons and proceeding to pass a death sentence on the fifth one. They said the trial judge could be accused of selective application of evidence.
Trouble started when the Central Provincial State Counsel, Ammon Oluoch, expressed his disatisfaction with the release of the four relatives who had allegedly murdered a neighbour shortly after he was acquitted of killing and raping their daughter.
