The Catholic Diocese of Richmond cannot have the evidence from Derek Barnabei's murder trial, a judge ruled

The Catholic Diocese of Richmond cannot have the evidence from Derek Barnabei's murder trial, a judge ruled. Circuit Judge Charles E. Poston denied, without explanation, the diocese's request to have the evidence for further DNA testing. On January 22, the Roman Catholic Diocese of Richmond asked the Norfolk Circuit Court to release evidence in the murder case of Derek R. Barnabei so the DNA can be tested in an effort to prove his innocence. Barnabei, 33, was executed Sept. 14 for raping and killing 17-year-old Sarah J. Wisnosky in 1993. Barnabei had dated the Old Dominion University freshman.
