The death penalty is applicable to those of 17 years and above at the time of the crime. Idaho does not forbid the execution of juvenile offenders but does have life without parole.
In February 2003 Governor Dirk Kempthorne approved a law adopting the provisions following the Supreme Court ruling on Ring v. Arizona. A judge decides the sentence. The State Commission of Pardons and Paroles has the authority to grant clemency. Also the Governor may grant respites and reprieves not extending past the next session of the Commission.
