The death sentence for a man who strangled his 2nd wife was vacated by the state Supreme Court. Timothy Boczkowski, 48, was sentenced to death in May 1999 for killing Maryann Boczkowski in 1994. He previously had been convicted of killing his first wife, Elaine Boczkowski, in 1990. The high court ruled that the trial judge mistakenly let the jury consider Elaine's killing as an aggravating factor in Maryann's death. Boczkowski must now be resentenced in Allegheny County to life in prison. All 6 voting justices supported Boczkowski's conviction, and only Justice J.
