The Third U.S. Circuit Court of Appeals has ruled that Arnold Holloway, 62, a black man sentenced to death, should get a new trial because prosecutors improperly excluded blacks from his jury, According to the court, an assistant district attorney at Holloway's 1986 trial used 11 of his 12 peremptory strikes during the jury-selection process to eliminate blacks. The unanimous ruling by a three-judge panel of the Court means death-row inmate Arnold Holloway must be set free unless the Philadelphia District Attorney's Office gives him a new trial within 120 days. Holloway was convicted of first-degree murder and sentenced to death in May 1986 for the May 16, 1980, strangulation and shooting of Richard "Ricky" Caldwell, 17, a fellow drug dealer.
