The government might use Charlie "Atong" Ang and Yolanda Ricaforte as state witnesses in former President Joseph Estrada's plunder case, Vice President and Foreign Affairs Secretary Teofisto Guingona Jr. said.
Ang and Ricaforte are facing plunder, which is punishable by death, for allegedly receiving kickbacks from the tobacco excise tax which should have gone to the provincial government of Ilocos Sur.
Ang was arrested by the Federal Bureau of Investigation on November 25 on the request of the Philippine government, and the hearing for his extradition is being held in US courts
Under the extradition treat with the Philippines, the US may refuse extradition if the offence for which the person is being accused is punishable by death. The treaty would require the Philippines, in this case, to assure that lethal injection would not be carried out on Ang, if he is extradited.
Ricaforte is still at large and believed to be in California.
