In a 4-3 decision, the high court ordered a new trial, saying prosecutors rejected five blacks from the jury in violation of the 1986 U.S. Supreme Court case of Batson vs. Kentucky that said prosecutors must show reasons besides race to eliminate blacks from serving. McFadden is black.
