The Missouri Supreme Court unanimously overturned the death sentence of Ernest Lee Johnson, 42, convicted of killing 3 people in 1994, because his attorney did not present adequate evidence that he might be mentally retarded. The court sent Johnson's death sentence back to a Boone County court and ordered a new sentencing hearing. It had overturned an earlier death sentence for Johnson in 1998, saying he had an ineffective lawyer. Johnson was convicted in 1995 of bludgeoning to death Mable Scruggs, 57, Fred Jones, 58 and Mary Bratcher, 46.
