The six King'ong'o prisoners were battered to death by warders, and there was no escape bid as claimed by the jail authorities, a principal magistrate ruled at the inquest into their deaths.
Claims that the six died while trying to escape were made up by the prison authorities to cover up what really happened at King'ong'o prison in Nyeri, magistrate Maureen Odero said.
"The six did not meet their death by way of accident or misadventure. Their deaths were the result of culpable warders known to the department of prisons," Odero ruled.
The inquest, ordered by the Attorney General, was into the deaths of Peter Koring, Peter Lumukunyu, Peter Ngurushne, James Irungu, John Njoro and Julius Mungania, on September 4, 2000.
Odero said the 44 prison warders who gave evidence during the inquest were not honest to the court.
Their evidence was contradicted by one of the survivors, Esokon Kionga, who said all the eight inmates were led out of the cell and set upon by the warders but he managed to escape.
