The state has not the life without parole option. The method of execution is injection. The sentence is determined by a jury. The death row is located at Santa Fe. As for the clemency process, the Governor has sole authority to grant clemency.
On February 12th 2007, the House of Representatives of New Mexico approved a bill that abolishes the death penalty, replacing it with life imprisonment without parole but the bill was halted by the Senate Judiciary Committee on March 8.
