The state Senate killed a bill that would have prohibited a judge from issuing a death sentence if the jury deadlocked during the sentencing phase of the trial

The state Senate killed a bill that would have prohibited a judge from issuing a death sentence if the jury deadlocked during the sentencing phase of the trial.
Allowing a judge to override the jury is unconstitutional, said Sen. Anita Bowser, the bill's sponsor, and some death sentences could be overturned in the future as a result.
Bowser, D-Michigan City, said the bill was recommended by a criminal justice commission charged with studying the death penalty in Indiana.
The Senate voted down the bill 28-20.
