The state Supreme Court has ruled 4-to-3 that Richard Haberstroh, 48, deserves a new penalty hearing for the 1986 kidnapping, rape and murder of Donna Marie Kitowski. The court's order said a jury's finding of "depravity of mind" as an aggravating circumstance warranting the death penalty was improper. The majority opinion favored Haberstroh only in regard to the new penalty hearing. All 7 justices agreed that his murder conviction should stand.
