The state Supreme Court ordered a new sentencing hearing for a man sentenced to death, ruling that the man did not get to fairly question a witness. Ronald O'Neal Valentine was convicted in January 2000 of the shooting death of Steve Hannah. The only aggravating factor -- or legal justification for Valentine's death penalty -- was a prior conviction for a violent felony, assault with a deadly weapon inflicting serious injury. The judge did not allow Valentine's lawyers to fully question the victim in the case about a notarized affidavit signed by the victim, which said Valentine had not committed the crime, the Supreme Court ruled. The error merits a new sentencing hearing, the justices decided.
