The state Supreme Court ordered a new sentencing hearing for Herman Henry "Bud" Von Dohlen. In his appeal, Von Dohlen argued that his attorneys were ineffective because they failed to present evidence in the penalty phase of the trial that he suffered from severe, chronic depression when he killed 21-year-old Margaret McLean in 1990. The justices said in their ruling that the information could prompt the jury to recommend a sentence of life in prison rather than death.
