With a 6-2 vote, the Supreme Court rejected a proposal that stated since Mexico has signed international extradition treaties, then there is a tacit agreement to hand over Mexican citizens so they may be tried under specific laws of each nation, even if this includes the death penalty.
The Supreme Court ruled the death penalty and life sentences go against Article 22 of the Mexican constitution and are considered excessive and inhumane.
Its decision was based on Article 18 of the Mexican constitution, which states the objective of a prison term is social rehabilitation, a humanitarian end that is not reached if the prisoner is never set free.
