the Zambian Supreme Court sitting in Ndola granted freedom to a man sentenced to death while the another had his death sentence substituted for 10 years imprisonment.
Justice Peter Chitengi, sitting with Deputy Chief Justice Irene Mambilima and acting Supreme court Justice Timothy Kabalata, said the court did not find any evidence to link Rambo Mutete to the offence of murder and aggravated robbery. Mutete was appealing against conviction and death sentence together with two other appellants, Christopher Nguni and Abel Mwanza. On May 17, 2001, the trio allegedly murdered Doubt Munsaka while on the second, the trio stole items valued at K350, 000 from Munsaka’s home. A lower court found the trio guilty and sentenced them to life imprisonment for which they appealed against both conviction and sentence.
