UGANDA: COURT OF APPEAL QUASHES DEATH SENTENCE AGAINST TWO

two people, who were sentenced to death for robbery, were acquitted by the Ugandan Court of Appeal. In 2000, the then Jinja High Court resident Judge, Faith Mwondha, sentenced Kassim Isiko and Madina Nagudi to death for aggravated robbery. However, the appeal court last week ruled that the evidence that was submitted against the two was not sufficient to warrant their conviction. The appeal was heard by justices George Engwau, Amos Twinomujuni and Stephen Kavuma. But the justices upheld the death sentence against the duo’s co-accused, Yahaya Lukwago, saying the victims of the robbery had identified him during a suspects’ parade. “It seems to us that the sole reason why Isiko and Nagudi were convicted was that they were found in Mbale town in Nagudi’s restaurant where Lukwago was arrested,” the court argued.
