Three men wept in disbelief inside a High Court in Nakuru when a judge substituted a five-year sentence they had appealed against with that of death.
Justice Alnashir Visram rejected the appeal by Moses Gitonga, Samwel Kinyua and Charles Mwangi.
The trio had been charged with robbery with violence which was reduced to simple robbery by the then Nyahururu Senior Resident Magistrate, Walter Nyarima.
They had been sentenced to serve five years imprisonment with five strokes of the cane and were to be placed under police supervision for five years after serving the jail term.
Justice Visram said the trial magistrate was not justified in reducing the offence of robbery with violence with that of simple robbery and sentenced the trio to death.
They looked at the judge with disbelief and wept as they were led down to the underground cells.
