A pregnant woman found guilty of murder was saved from the hangman's noose by her unborn baby. Anne Ngonyo will now spend the rest of her life in jail.
"The innocent life in your womb has saved your day," Mr Justice Mbogholi Msagha said in passing sentence on the defendant.
A medical report was presented to the judge, confirming that Ngonyo was 36 weeks pregnant. On March 12 the judge sentenced all seven of Ngonyo's co-accused - among them the wife of a former Commissioner of lands Wilson Gachanja, Elizabeth Gitiri Gachanja - to death for the killing of businessman Lawrence Githinji Magondu but suspended Ngonyo's sentencing after her lawyer drew the attention of the judge to the fact that she was pregnant.
Ngonyo was in the group that lured Magondu to his death in Kitengela, in Kajiado on February 4, 2000, pretending that they wanted to discuss a land deal.
The judge asked the Commissioner of Prisons, Abraham Kamakil to unravel the puzzle of how Ngonyo conceived while in custody where she has been since 2000. Sources said Ngonyo, who has been in custody since February 11, 2000, conceived at the High Court basement cells. The father of her unborn baby is believed to be one of the men convicted with her for the Magondu murder.
The Prisons Department could not say where or how the woman got pregnant.
