Two alleged Mexican drug smugglers would not be extradited from Australia if it meant they would face the death penalty in the US.
Crown prosecutor Ray Plibersek told the Federal Court in Sydney that under Australian law, no person could be extradited if they would be subject to the death penalty in the applying country. The court adjourned the appeal against extradition to the US by Francisco Rios Balderrama, 32, and Armando Garcia Quiros, 33.
