Uganda's Attorney General (AG) supported capital punishment issued by Field Court Martial, describing it as necessary to instil discipline in soldiers.
"The death sentence prevents soldiers from killing civilians and deserting the forces, which jeopardizes the whole army," Cheborion Barishaki, the Commissioner for Civil Litigation in the AG's Chambers, told the Constitutional Court.
Barishaki was opposing an application by Uganda Law Society (ULS), seeking orders to suspend the execution of the UPDF soldiers pending the final determination of its petition that challenges the constitutionality of the operation of a statute that empowers the Field Court Martial to pass a death sentence and immediately execute soldiers without appeal to the Supreme Court.
The ULS contends that this statute is unconstitutional.
Philip Karugaba, one of the four ULS advocates, also contented that the Field Court Martial is not a court of competent jurisdiction. He asked the Constitutional Court to suspend the execution of the UPDF soldiers in the north pending the determination of their petition.
