U.S. District Judge Sim Lake ordered the state to release death row inmate Theodore Goynes from prison or grant a new sentencing hearing within 120 days because his low intelligence and history of mental illness were not considered when he was sentenced in 1991. Lake wrote: "Goynes is not retarded. He does, however, have very low intelligence and a long history of mental illness". Goynes confessed the Oct. 7, 1990 rape and murder of Linda Marie Tucker, 25.
