A jury has recommended 10-2 the death penalty for Donald Whatley. Whatley, 34, was found guilty Monday of the Dec. 28, 2003 killing of 43-year old Pete Patel. Mobile County Circuit Judge Joseph Johnston will sentence Whatley on Dec. 11. Whatley was arrested nearly 3 years later. As he sat in a Texas jail charged with the murder of a 56-year-old woman, he contacted Alabama authorities and confessed to the Patel killing.
