A Jefferson County jury recommended that Marcus Benn should be put to death after convicting him of shooting 3 people and leaving their bodies on 3 different roadsides. Benn, 38, Black, was found guilty of capital murder in the Dec. 27, 2010 deaths of Jaime Luna Gutierrez, Jose Manuel Martinez Calderon, and Evelyn Peralta. Jurors deliberated on a sentencing recommendation and voted 10-2 for the death penalty. Circuit Court Judge Tracie Todd can choose to follow it or override it and impose a sentence of life without parole. Benn testified that he shot the two men because he was afraid for his life and a gun was pointed in his face. He said that he was in a pickup truck with Gutierrez and Calderon, who pulled a gun. There was a struggle, and Benn ended up with the pistol. He turned his back against the passenger door and pointed the gun at the men, firing blindly, he said. He has denied any involvement in Peralta's death.
