Circuit Judge John Bush overruled the jury's recommendation and sentenced Calvin McMillan to the death penalty. McMillan, 20, was convicted in June of 2 counts of capital murder in the Aug. 29, 2007 shooting death of James Bryan Martin, 23. The Elmore County jury had recommended 8-4 that McMillan receive a sentence of life without parole.
