Lauderdale County Circuit Judge Mike Jones sentence David Dewayne Riley Jr., 26, white, to death for the 2005 slaying of 38-year-old Scott Michael Kirtley. He upheld the March 11 Lauderdale County jury’s recommendation. Kirtley was shot to death during a liquor store robbery. Before the sentence, Riley apologized to the victim's family. It is the 2nd time Riley has been convicted and sentenced to die for killing Kirtley. He also got the death penalty in 2007, but in december 2007 the Alabama Court of Criminal Appeals reversed the conviction, citing comments about Riley's juvenile arrest record made by the prosecution during the trial as grounds for the reversal.
