By a vote of 10-2, a jury today recommended the death penalty for William Kopsho. A jury in Florida, unlike most other states, does not have to reach a unanimous finding for an advisory death sentence. Circuit Judge David Eddy will sentence Kopsho at a later date, giving the jury's recommendation great weight in his decision. First, he will hold what's known as a Spencer hearing within the next several weeks, giving the defense one last chance to present additional mitigating evidence in favor of a life sentence. 4 years ago, in the same case, Eddy sentenced Kopsho to death following a different jury's 9-3 recommendation for capital punishment. The defendant's conviction and sentence that time around were later overturned by the Florida Supreme Court (see May 24, 2007) based on a technical error that occurred during jury selection. Kopsho, 55, confessed he shot his 21-year-old wife, Lynn Ann Kopsho on October 27, 2000. He was first sentenced to death in April 2005.
