The Florida Supreme Court has reversed another non-unanimous death sentence under Hurst v. Florida, granting a new sentencing to Justin McMillian. On June 30, 2010 (see) two jurors in McMillian's case had voted to recommend sentencing him to life. Circuit Judge David Gooding sentenced McMillian to death on Oct. 1, 2010 (see). McMillian, 33, Black, was found guilty of 1st-degree murder in the shooting death of his ex-girlfriend Danielle Stubbs, 26, black, in January 2009. He admitted shooting over her admission that she had aborted the couple's unborn child, but said he did not intend to kill the girl.
