The Georgia Supreme Court has reinstated the death penalty for Andrew Howard Brannan. Brannan, 59, white, was convicted of the January 1998 killing of deputy Kyle Dinkheller, 22. Brannan, a Vietnam veteran, pleaded insanity and claimed he suffered from post-tramautic stress. A Butts County judge in 2003 threw out his death sentence, say Brannan's lawyer didn't present evidence on his mental-health history. But the state's high court unanimously overruled that, saying the jury heard those arguments and rejected them. The judges said Brannan's death sentence will stand.
