A Bullitt County jury has recommended a death sentence for Michael Dale St. Clair, an inmate who escaped from an Oklahoma prison and then killed a man. St. Clair, now 54, white, had been convicted in 1998of murdering Frank Brady on Oct. 6, 1991, but won a new sentencing when the Kentucky Supreme Court found errors in his trial 3 times, most recently in April 2010, when it upheld his conviction but overturned the death sentence. Sentencing is scheduled for Nov. 16. St. Clair was in jail in Oklahoma, on two 1991 murder convictions, when, in Sept. 1991, he escaped and killed three more people, including Frank Brady. St. Clair was first sentenced to death on Sept. 11, 1998 for kidnapping and killing Brady. But in 2005 the conviction was overturned after the Kentucky Supreme Court ruled  that a judge improperly allowed St. Clair's ex-wife to testify against him. Then he was sentenced to death again on Sept. 30, 2005, and on April 22, 2010 the death sentence, by a 5-2 vote, has been overturned again because the trial court had erred  by incorrectly instructing the jury that they could consider all of St. Clair's prior convictions for capital murder at the time Brady was killed. St. Clair has been convicted of 4 other murders and is also under two sentences of life without parole for the murders committed in Oklahoma. (see also Sept. 7, 2005).
