Judge John Tylwalk sentenced Freeman May to life in prison without possibility of parole. May, 56, White, who was found guilty by a Lebanon County jury and sentenced to death in 1991, had his death sentence vacated by President Judge John Tylwalk today. Tylwalk imposed a sentence of life in prison without the possibility of parole. Today's hearing followed an April 17 (see) hearing, during which Tylwalk ruled May to be an incapacitated person who "is also incompetent to proceed." District Attorney David Arnold offered May a sentence of life in prison following a Jan. 31 hearing in Tylwalk's chambers and after Arnold met with the family of May's victim, Kathy Lynn Fair. Harrisburg attorney Barbara Zemlock, who, along with Philadelphia attorney Jules Epstein represents May, said the agreement includes an acknowledgment that May will withdraw his pending state and federal appeals. May had been scheduled for execution on May 5, 2013, but the U.S. District Court for the Middle District of Pennsylvania stayed that order on Jan. 23, 2013. Fair, a young mother, was reported missing in September 1982. Her remains were found 6 years later in a wooded part of South Lebanon Township by a man and his son who were cutting wood. May became a suspect because he had been convicted of a similar crime. In December 1982, May stabbed a 15-year-old girl and a 19-year-old woman, raping 1 and leaving both of them for dead near where Fair's remains were later found. Both victims survived and identified May, who had given them a ride from a party.
