Texas’ House of Representatives passed HB 1936 that would ban the execution of severely mentally ill inmates. Under the measure, proposed by Rep. Toni Rose, D-Dallas, defendants who have active psychotic symptoms of certain mental illnesses at the time of the crime would be ineligible for capital punishment. It passed by a vote of 77-66, with all 64 democrats voting in favor, together with 13 Republicans. All the 66 “nay” votes came from Republicans.
