A labourer burst into tears when he escaped the gallows for trafficking in cannabis, simply because the prosecution failed to tender a fingerprint report.
High Court judge Datuk R.K. Nathan said the absence of a report left the court in doubt as to whose fingerprints were on the plastic packets containing the cannabis.
He acquitted Majiddin Abdul Majid, 28, of trafficking in 37,174gm of cannabis at No 4A, Jalan Sungai Nibong, Bayan Baru, at 3pm on Sept 15, 1997.
He was charged under Section 39B(1)(a) of the Dangerous Drugs Act 1952, which carries the mandatory death sentence.
"You are very lucky," Nathan told Majiddin, warning him not to "do it again".Bursting into tears, Majiddin thanked and hugged his counsel C.V. Prabhakaran before leaving the court with family and friends.
Prabhakaran was assisted by N. Kanagavalli while deputy public prosecutor Azman Abu Hassan prosecuted.
