A man who has spent 20 years on death row for killing a 12-year-old girl had his conviction and death sentence overturned for a 2nd time. A federal judge ruled that the state must grant Rodney James Alcala a new trial within 120 days or free the San Quentin inmate. U.S. District Judge Stephen V. Wilson ruled that Alcala's 1986 retrial in Orange County Superior Court was unfair because the judge "precluded the defense from developing and presenting evidence material to significant issues in the case." In addition, Alcala's lawyers "unreasonably failed" to present evidence of an alibi, Wilson said. Alcala, a photographer from Monterey Park, was first convicted and sentenced in 1980 for the murder of 12-year-old Robin Samsoe in 1979.
