Austrian Second President of Parliament and SPÖ presidential candidate Heinz Fischer welcomed the news that the US Supreme Court had ordered a new trial for convicted murderer Kevin Cooper, who had been scheduled to die by lethal injection. Fischer said, however, that "it would have been better if the governor of California, Arnold Schwarzenegger, had himself come to such a decision and changed his decision to refuse to grant Cooper clemency on the grounds that there was overwhelming proof of his guilt."
