Bosnia and Herzegovina has signed but not yet ratified Protocol No 13 to the European Convention on Human Rights and Fundamental Freedoms banning the death penalty in all circumstances.
A new draft Criminal Code for the whole of Bosnia and Herzegovina does not refer to the death penalty at all. Certain provisions on the death penalty are still retained in the law of the two entities, but if the draft law is adopted, the entity codes will be harmonized with this Code.
