In Bay Minette, Circuit Judge Robert Wilters overruled a jury's recommendation and sentenced John Earl "Buckshot" Morrow, 33, to death for the November 2000 slaying of Thomas F. Philyaw. Morrow is the 2nd man in 2 days to get a death sentence for the killing of Philyaw. Wilters issued the sentence despite an 8-4 recommendation by the jury that he be sentenced to life in prison without the possibility of parole. On the 16th, the judge upheld a jury's recommendation and sentenced Timothy Keith Flowers, 20, to death in the same case.
