In Columbus, voting 4-3 the Ohio Supreme Court tossed out the death penalty sentence of convicted cop killer Tony Gross, saying alternate jurors tainted the deliberations.
In a 4-3 ruling, the high court ordered Muskingum County court to sentence Gross again. But it remains unclear if Gross can again be given the death penalty. By a 6-1 vote, the Court upheld the conviction.
Gross was convicted of aggravated murder in the July 12, 1994 death of Lieutenant Mike Lutz.
The court ruled that alternate jurors should not have been allowed in the deliberation room during the penalty phase of the trial. The court's ruling orders a new sentencing hearing in the Muskingum County Common Pleas Court
