In Denver, the 10th U.S. Circuit Court of Appeals, citing a "grossly deficient" defence attorney and misconduct by prosecutors, has overturned the death sentence of Marcus L. Cargle. The Court ruled 3-0 that Cargle did not receive a fair trial in the guilt or penalty phase when tried for the 1993 murder of Sharon Paisley and her husband, Richard, 33. Cargle was 19. The decision allows the district attorney's staff to put Cargle on trial again "within a reasonable time." Otherwise, he could be released from prison.
